FACTS: Plaintiff, a 60 year old man, Part-time dietary clerk, was riding a bicycle to visit friends in the Bronx at 10 p.m. As plaintiff was crossing the Washington Bridge from Manhattan to the Bronx, he was struck by a bus that was being driven by the defendant. Plaintiff claimed that he was riding in the bridge's far right lane and that the bus approached him in the same lane. Defendant claimed that the plaintiff was weaving in traffic. Plaintiff was not wearing any reflective clothing
INJURIES:Plaintiff claimed that he was unconscious when he was transported by ambulance to Harlem Hospital Center, where he was admitted for two months and underwent four surgeries: an exploratory laparoscopy and splenectomy for the removal of his spleen and to identify the source of his internal bleeding; a tracheotomy; closed reduction and external fixation for his left, non-dominant, wrist; and open reduction and internal fixation of his fractured left ankle. Plaintiff also claimed that he sustained fractured ribs and a fracture of the transverse process of the C6 vertebra.
