While at Shafer Glazer she has successfully acquired an affidavit prior to discovery commencing from our client’s employee who witnessed plaintiff’s fall in a chair, stating that the chair was not furnished, controlled or discarded by our client, illustrating that it had nothing to do with the fall. Based on this, we moved to dismiss the third-party complaint on the grounds that there was no contractual duty for our client to provide or maintain the chair that Plaintiff collapsed on and that no witness has purported any activity by our client that could have damaged the chair. The motion was granted and all claims dismissed.
She further obtained a settlement of $18,000 significantly lower than the cost of lengthy defense despite the fact that plaintiff sustained a slash mark on the face.
The firm received a case with the note of issue filed where plaintiff sustained a serious head injury. During the event in question, the plaintiff was robbed, assaulted, and struck in the head with a baseball bat by an unidentified assailant while he was on the client’s premises. We hired a security expert that showed that Plaintiff regularly deposited large sums of cash in a patterned manner unaccompanied at night, which made him an target to the perpetrator. Prior to Shafer Glazer being engaged there was a $250,000 demand. While the motion was pending the case was settled for substantially less than the demand from 250K to 25K.
She has had many other successful settlements and even had parties enter into a stipulation of discontinuance with the Plaintiff at no cost to our client.
